Terms and Conditions – Van Speyk

Definitions
Customer: The (legal) person who has entered into an agreement with Van Speyk.
Products: The products offered by Van Speyk, as agreed verbally or in writing.
Services: The services provided by Van Speyk, as agreed verbally or in writing.
Agreement: The agreement (including these Terms and Conditions) between Van Speyk and the Customer.
Website: The website of Van Speyk.
Webshop: The webshop operated by Van Speyk, containing the full range of products and services offered.

General
These terms apply to all agreements, offers, and orders between Van Speyk and its Customers. Deviations are only valid if confirmed in writing by Van Speyk. Van Speyk reserves the right to change these terms at any time.

Agreement
An agreement is only concluded after acceptance of the offer and confirmation by Van Speyk. By placing an order or accepting an offer, the Customer agrees to these terms. Van Speyk may refuse orders without stating a reason.
All offers from Van Speyk are non-binding. If Van Speyk is unable to fulfill an order, the Customer will be informed as soon as possible. No rights can be derived from this.
Van Speyk may cancel the agreement without legal intervention if the Customer passes away, is under guardianship, is declared bankrupt, applies for suspension of payment, or if any of their assets are seized.
Ownership of products only transfers to the Customer after full payment. Handmade products may slightly vary in size due to their artisanal nature.

Prices
All prices on www.vanspeyk-horloges.nl and www.vanspeyk-watches.com include Dutch VAT, unless otherwise stated.
Van Speyk may adjust prices. Prices for business orders are listed excluding VAT. Obvious pricing errors do not create entitlement.

Payment and Delivery
Van Speyk accepts the following payment methods:

  • Credit card (Visa, Mastercard, Maestro)

  • iDEAL

  • PayPal

  • Bank transfer

Orders are confirmed by email and include total costs. Products are shipped free of charge via registered and insured delivery.
Orders are delivered within 30 days unless otherwise agreed. If delayed, the Customer will be informed within one month and may cancel the order free of charge.
If a package is lost or delayed, Van Speyk will initiate an investigation with the carrier. Only after official conclusion will the order be resent or reimbursed.

Returns
The Customer may cancel their order within 14 days of receipt, followed by another 14 days to return the product.
Return conditions:

  • The item must be in original condition, unused, with tags and in original packaging.

  • The original invoice must be included.

  • Return shipping is at the Customer’s risk and expense.

  • Insufficiently stamped returns will not be accepted.

  • Custom or personalized products cannot be returned.

  • Returns from outside the EU must be marked as “returned product” to avoid import duties.

Van Speyk may deduct costs for damaged or incomplete returns. Ownership of returned products reverts to Van Speyk if payment is incomplete.

Ownership Rights
All intellectual property rights on content, visuals, software, and product designs remain with Van Speyk.

Liability
Van Speyk will repair or replace defective items. Refunds are only possible if agreed.
Van Speyk is not liable for damage caused by misuse or incorrect use of its products. Van Speyk is not responsible for user comments on the website or for typographical or pricing errors.

Warranty
Products come with a 36-month warranty against manufacturing defects, unless stated otherwise.
Exclusions:

  • Glass, crown, strap, or clasp

  • Water damage due to improper use

  • Damage due to misuse or improper handling

  • Unauthorized repairs

To claim warranty: provide a clear defect description and invoice. Van Speyk will repair or replace the item; refunds are not possible. If the defect is not covered, repair costs will be quoted before proceeding.

Force Majeure
Van Speyk is not liable for delays or failure to perform due to force majeure.

Privacy Statement
Van Speyk treats customer data with care and will never share it with third parties, except for processing your order or legal obligations.
Collected data is used to:

  • Process your order and payment

  • Keep you informed about your purchase

  • Improve our website and service

  • Send promotions (only with your consent)
    You may unsubscribe at any time. Cookies help us recognize returning visitors and optimize the experience. You can disable cookies in your browser.

Changes
Van Speyk may update these terms and conditions. Changes also apply to existing agreements.

Governing Law
Dutch law applies to all agreements. Disputes are handled by the competent Dutch court.
